Recent News:
On May 2, 2018, Judge Gregory H. Woods of the Southern District Court of New York, following a 4-day bench trial including two days of expert testimony on "commercial reasonableness" in the context of a breach of contract action, entered judgment dismissing the action. Holland Loader Co., LLC v. FlSmidth A/S, 313 F. Supp. 3d 447 (S.D.N.Y. 2018).
Exactly one year and a day later, on May 3, 2019, in a ten page Summary Order the Second Circuit Court of Appeals unanimously affirmed Holland Loader Co. LLC v. FLSmidth A/S, 769 Fed.Appx. 40, 43 (2d Cir. 2019). The case had been orally argued by Stephen M. Harnik only 4 days prior to the Court of Appeal's Order. The circuit judges were Barrington D. Parker, Denny Chin and Susan L. Carney.
