Does Julian Assange have a First Amendment Defense?


Stephen M. Harnik and Armin Kaiser have recently published an article in [Statement], an Austrian media magazine, concerning the US Justice Department's 17-count indictment of Julian Assange. The Government alleges that he violated the Espionage Act of 1917 by publishing classified material, and is seeking his extradition. The article analyzes whether, as a non-US person, he may have a First Amendment defense to the charges, assuming he qualifies as a journalist.
